Kevin F. Rooney joined the firm in 2006. He specializes in commercial litigation, including business litigation, unfair business practices class action litigation, real estate litigation, construction litigation and employment litigation.
Experience
Mr. Rooney is an experienced and versatile attorney with over fourteen years of extensive litigation experience including business litigation on behalf of both plaintiffs and defendants as well consumer class actions and unfair business practices litigation. Over his career, he has successfully tried jury and bench trials in state and federal court, authored and argued appellate briefs and argued scores of critical law & motion issues in matters ranging from breach of contract to misappropriation of trade secrets and unfair competition. Mr. Rooney also has valuable antitrust experience, working for Cleary Gottlieb Steen & Hamilton in Washington, D.C. and New York City from 2003-2006 on billion dollar plus antitrust litigation matters including Oracle’s hostile takeover of PeopleSoft. Mr. Rooney is an astute negotiator, recognizing his clients’ business and operational goals in litigation.
When it serves his clients' business objectives, Mr. Rooney successfully crafts creative solutions that allow for cost-efficient resolution of matters through private negotiation, mediation, arbitration and other means of alternate dispute resolution.
Recent Representative Engagements
- Successfully brought class action against Citibank achieving 100% student loan forgiveness and other benefits amounting to more than $6 million in forgiveness.
- Successfully tried insurance bad faith matter to a jury, recovering all requested damages in excess of $400,000.
- Successfully co-chaired federal jury trial alleging violations of the Civil Rights Act.
- Obtained a significant pretrial settlement on behalf of a real estate development company against well funded defendants alleging trade secret misappropriation and unfair competition.
- Obtained judgment on behalf of a commercial landlord for breach of lease.
- Successfully defended an employer facing allegations of unpaid commissions by a former employee.
